Pursuant to Section 52(2)(a)-(b) of Act C of 2003 on Electronic Communications (“Electronic Communications Act”), the NMHH maintains official records of electronic communications service providers and the services they provide, as well as of interface notifications required for the performance of electronic communications activities on electronic communications networks or for the provision of services. The Authority shall carry out the following tasks in relation to the maintaining of records.

Registration of a service provider or service

The intention to commence the provision of electronic communications services and the proposed date of commencement, with the exception of number-independent interpersonal communications services, shall be notified by the electronic communications service provider to the Authority for registration purposes.

The Authority shall enter the service provider, based on the information supplied in the notification, into the register of electronic communications networks and providers of electronic communications services, and shall send a confirmation of registration within seven days from the date of registration.

The register maintained by the Authority shall be construed a public register in respect of the name of the provider of electronic communications services and the indication and brief description of the electronic communications services, or the electronic communications network if the notifier operates an electronic communications network, an indication of Union Member States affected by the service, planned date of launching the service, and the provider’s website address, associated with the operation of the electronic communications networks or the provision of electronic communications services and shall be published and made available to the public accordingly.

Developing and publishing a classification system of networks and services

The Authority has developed a classification structure for the classification of electronic communications networks and electronic communications services, which is published on its website. The Authority shall register the service provider in its register of electronic communications networks and electronic communications service providers according to the classification established and published by the Authority.

Issuance of a certificate of entitlement to provide services

Upon written request of the service provider, the Authority shall issue a certificate confirming that the service provider is authorised to operate an electronic communications network and to provide services through an electronic communications network in the territory of Hungary.

Changes to the data of the service provider and/or service

Providers of electronic communications services shall notify the Authority of any changes in the information supplied in the notification within 15 days. In accordance with the notification of the change, the Authority shall enter the data change in its register of electronic communications networks and services.

Cancellation of a service provider and/or service

In the event of the dissolution or death of an electronic communications service provider, or upon the termination of electronic communications services, the Authority shall cancel the electronic communications service provider from the register of electronic communications networks and services, and shall withdraw its authorization for the use of the identifier issued to such service provider, and shall make these actions public.

Acceptance of General Terms and Conditions

The electronic communications service provider providing subscriber services shall draw up general terms and conditions for subscriber services. The electronic communications service provider must publish the general terms and conditions at its customer service and on its website, and must send them to the Authority.

Register of interfaces

The operator of an electronic communications network or the service provider is required to notify the Authority of the specifications of subscriber and network interfaces used in connection with the performance of electronic communications activities or for the provision of services, and shall make them available to the public. The interface shall be notified before the commencement of services. The Authority shall register the notified interface specifications, the register shall be considered public information.
