This section covers NMHH's tasks and activities related to media content, media content providers and media content services, including the notification of media services and press products, as well as the official supervision and control of media content and media services.
Media content
Media content shall mean any content offered in the course of media services and in media products. The terms media service and press product are defined in both the Media Act and the Press Act.
Media service
A media service is an autonomous economic service provided regularly on a commercial basis, for profit and at an economic risk, the primary purpose of which, or of a separable part thereof, is the distribution to the public, via an electronic communications network, of programmes for information, entertainment or education falling under the editorial responsibility of a media service provider.
A programme is a series of sounds or moving or still images, whether moving or silent, which form a single unit, regardless of its duration, in a programme schedule or programme offer established by a media service provider.
Press products
Press products are daily newspapers and periodicals, as well as online newspapers or news portals provided as a commercial service, the content of which is the editorial responsibility of a natural or legal person as the editor, and the primary purpose of which is to provide the public with content consisting of text or images for information, entertainment or education, in print or via an electronic communications network. Editorial responsibility shall include the responsibility for the actual control over the selection and composition of the media content and shall not necessarily result in legal responsibility in connection with the media service. An economic service is a regular service provided independently on a commercial basis for profit and at an economic risk.
Official tasks relating to media content, media services and press products
According to the Media Act, one of NMHH's tasks is the registration of media services and press products. The Authority also supervises the operation of media content services and the enforcement of fundamental requirements relating to media content. Within this framework, the Media Council and the NMHH Office monitor the lawfulness of media content on the basis of citizens' complaints, ex officio or upon request, with particular regard to compliance with provisions on respect for human dignity, the prohibition of incitement to hatred and exclusion, the protection of minors and commercial communications. The Authority also monitors compliance with data reporting and quota requirements, obligations under public contracts and conflict of interest rules.
