Online platforms comprise a specific subset of hosting service providers within the category of providers of online intermediary services. This includes services that not only store but also make publicly accessible the content uploaded by users, and play an active role in its dissemination. Online platforms include in particular social media services, online marketplaces, app stores and content-sharing platforms. However, the EU’s Digital Services Act (DSA) explicitly excludes services where content is only accessible to a limited, non-public audience.

In addition to the general obligations, the DSA lays down specific rules for online platforms, including the following:

  • They must prioritise notifications from organisations that have been designated as trusted flaggers by the national Digital Service Coordinator.
  • They are obliged to cooperate in good faith in the proceedings of out-of-court dispute settlement bodies designated by the national Digital Service Coordinator.

Under the DSA’s provisions, providers operating very large online platforms (VLOPs) and very large online search engines (VLOSEs) are obliged to grant vetted researchers access to their data that is not publicly available.
