Authorisation of postal services substituting the universal postal service

The provision of postal services substituting the universal postal service is subject to authorisation. As part of this procedure, the NMHH examines whether the applicant meets the staffing, financial and technical conditions prescribed by law, and whether they are capable of lawfully providing a service with the same purpose as the universal service. The authorisation may be modified or revoked if a change occurs in the service provider’s data or activities, or if the conditions are not met.

Notification of postal service providers and postal services that do not substitute the universal postal service

The provision of postal services not substituting the universal postal service is subject to notification. For registration purposes, the service provider is required to notify the NMHH of its intention to commence the service 45 days before starting its provision. The notification must contain the information and annexes specified in the Postal Act.

Prior to registration, the NMHH will verify whether the information contained in the notification and the annexes thereto meet all legal requirements. If so, the NMHH will register the provider and the service(s) it intends to provide, which is a precondition for lawful operation. Failure to comply with the notification obligation may result in legal consequences.

Notification of changes to the data of a postal service provider/service

According to the law, if there is a change in the data of a postal operator or service (that has been provided for authorisation or registration purposes), this must be reported to the authority at least 45 days before the change is actually implemented.

Any changes occurring with regards to the identity or the activities of the intermediary organisation used for the collection, gathering, processing, transport and delivery of mail must be reported to the NMHH at least once per calendar quarter, in a monthly breakdown.

In the event of unforeseeable changes, changes that have already occurred must be reported within 8 days.

The notification of data changes ensures that the official registry is up-to-date and that the market operates in a transparent manner.

Deletion of a postal service or service provider

A postal service or service provider is deleted from the registry if a postal service provider ceases to exist or ceases to provide postal services.

The NMHH will also remove the service from the registry if the postal service provider fails to commence providing said service by the planned starting date indicated in the notification.

Notification of amendments to the general terms and conditions for postal services

Postal service providers are required to notify the NMHH of any changes in their general terms and conditions.
This notification must be made no later than 15 days before the planned date when the change will first come into effect.
