Unlike media service providers, video-sharing platform providers are not editorially responsible for the content they make available, and they have no influence over the actual content beyond the organisation and cataloguing of the content. At the same time, the role of certain intermediary service providers has been growing, leading to a shift away from their previous passive role and towards a degree of responsibility for third-party content. Following the amendment of the Audiovisual Media Services Directive (AVMS Directive), Act CLXXXV of 2010 (Media Act) extended the powers of the NMHH Office as of 1 August 2019 to include the registration and supervision of video-sharing platform providers.

The legislator introduced the specific rules, which have been in force since 12 June 2020, in Act CVIII of 2001 on certain issues of electronic commerce and information society services (E-Commerce Act) (Sections 15/C to 15/W), taking into account the intermediary nature of service providers.

Notification of video-sharing platform services

Pursuant to Section 15/C of the E-Commerce Act, the service provider of a video-sharing platform service may initiate its registration with the NMHH Office, which maintains an official register of video-sharing platform services.

Registration is not a condition for commencing the service.

Supervision of video-sharing platform services

In its regulatory capacity, the Office supervises the operation of video-sharing platform services, which it may examine either ex officio or on the basis of complaints from citizens.

Within this framework, the Office monitors

  • whether the obligations laid down in the relevant legal provisions are reflected in the general terms and conditions of video-sharing platform services,
  • whether appropriate measures and effective technical solutions are applied to illegal or harmful content,
  • whether transparent and user-friendly mechanisms are provided to users, and
  • whether the provisions on commercial communications are complied with.
