It is the responsibility of the NMHH to verify whether the organisations, companies and business operators providing communications services in Hungary, such as fixed-line or mobile telephone service providers, ISPs, cable providers or companies offering access to satellite television, perform their activities in compliance with the regulations applicable to this sector. Whenever the NMHH identifies a case of non-compliance during its supervisory activities, it takes action to ensure that the breach is remedied and the operations of the provider concerned is brought into compliance with the relevant legislation for the future.

By doing so, it protects the rights and legitimate interests of subscribers and service users, as well as fair market competition; indeed, without this control, irregularly operating providers would gain unfair advantage over their competitors.

The NMHH may also bring ex officio procedures against certain providers – in other words, it has the means to proceed within its own competence and at its own discretion. Nevertheless, it is also possible for users to initiate a procedure whenever they detect a breach and are unable to reach a satisfactory resolution with the respective provider.

Of the various tools available to the NMHH, the most important is that it is empowered to require the party in breach to remedy the breach and bring its operation into compliance. Once the relevant time limit has passed, or whenever the number of complaints start to rise again, the authority verifies compliance. The NMHH may also impose fines both as a sanction for breach and as a deterrent from future breaches, or call on the party in breach to publish the authority’s decision or communication to inform both the general public and the subscribers concerned. In particularly serious cases, it may also suspend or prohibit the provision of a service.

The NMHH is also responsible for the supervision of devices suitable for using and providing communications services. Since such devices use radio frequencies, they may interfere with each other during their operation. The authority works to eliminate such interference.
