Under the Meda Act and the Supervisory Fee Decree, service providers have the following obligations in relation to the supervisory fee:
- Annual data reporting on net domestic turnover from electronic communications or postal services
- Payment of the supervisory fee every six months
- Payment of the remaining supervisory fee upon the cessation of service activities
Supervisory fee rate
- 0.25% of the net turnover of electronic communications service providers from electronic communications services in the previous year,
- 0.133% of the net turnover of the postal operator from postal services in the previous year.
When registering a provider, the authority informs the provider of the rate and method of payment of the supervisory fee.
Data reporting on annual turnover
Pursuant to NMHH Decree 7/2016 (X.14.) on the Supervisory Fee, electronic communications and postal service providers are required to report to the Authority on the amount of their final annual domestic net turnover from electronic communications or postal services in the previous year, without being expressly requested by the authority, by 31 May each year. This amount is the basis for the supervisory fee. Data reports must separately include turnover from electronic communications and turnover from postal services. Reports must be submitted for each year when a service provider was registered with the authority as an electronic communications or postal service provider, even if the service provider did not generate any turnover from such services in a given year. The easiest way for electronic communications service providers to fulfil their reporting obligations is to submit an electronic form. This form is available through the authority’s “Data Gateway” after login. Its use requires Data Gateway registration.
Reports may also be submitted by post to the authority’s address (National Media and Infocommunications Authority, H-1525 Budapest, Pf. 75.)
NMHH Data Gateway (Adatkapu) is a web-based interface accessible via a web browser; no additional software needs to be installed to use it. The service is available only to users registered in the system.
Payment of the supervisory fee
The supervisory fee is paid in equal parts every six months to the authority’s payment account 10032000-00300939-00000017 held with the Hungarian State Treasury.
The authority issues invoices to help service providers comply with their fee payment obligation. The issuance of invoices is aligned with the reporting deadline so the authority’s Financial Department sends service providers invoices for the first six-month period in June and for the six-month period in December.
Commencement and cessation of service activities
When commencing service activities, a service provider is obliged to report on its turnover for the previous year (or, if applicable, part of that year) in its data reports submitted in the year following the commencement of its service activities. This turnover is the basis for payment of the supervisory fee for both the current year and the year of commencement.
When ceasing service activities, the authority issues the service provider ceasing its activities with an invoice for the outstanding supervisory fee to be paid by the deadline indicated on the invoice. Please note that final invoices are issued upon the completion of the procedure for removal from the register, but no later than when invoices for the billing period following the removal are issued.
Refund of the supervisory fee
The supervisory fee is used for a specific purpose. If, in a given year, the authority’s revenue from supervisory fees exceeds the amount needed to cover the expenditure necessary for the performance of its statutory functions, the authority will distribute the surplus among service providers and offset it against the fees due in proportion to payments made, after adopting the annual report for that year. The refund amount may not exceed the amount of the supervision fee actually paid in that year. The refund is an automatic process and the authority notifies those concerned.
