Data reporting obligations of universal postal service providers

The data reports required as per NMHH Decree 6/2017 (VI. 21.) on the reporting obligation of operators in the postal market to the communications authority and establishing the rules on data management must be provided in the format and according to the structure published on the Authority’s website.

Network electronic data must be prepared in XML format, using the appropriate structure, and delivered to the NMHH after conversion to XML file format, using the PC data exchange software. If the necessary IT conditions exist, the required data can also be prepared in XML format and delivered to the NMHH directly. The PC data exchange software offers support for creating the XML file.

It is important to note that data reporting must be completed using the forms created for this purpose.

The Authority would also like to draw the attention of postal service providers to the fact that they must submit their annual, regular postal market data reporting — as set out in NMHH Decree 6/2017 (VI. 21.), pertaining to data on traffic, revenue and costs related to the postal service, the quality of performance during the provision of the postal service, and the infrastructural, material and personnel resources used for the provision of the postal service — to the Authority by 31 March of each year following the reference year by filling in the electronic form available on the Authority’s website.

NMHH Data Gateway (Adatkapu)

The Data Gateway is the NMHH’s electronic administration platform. This service is only available to users registered in the system.

Postal requests, notifications (for cases without any history)

Data reporting on changes to network data

Pursuant to Section 2(2) of NMHH Decree 6/2017 (VI. 21.) on the reporting obligation of operators in the postal market to the communications authority and establishing the rules on data management, postal service providers must provide the Authority with information on the addresses of postal service points, collection and delivery points, and customer service points – indicating the postal code, municipality, street, house number, additional address information, as well as opening hours and contact details (including telephone numbers and email addresses) – by submitting the relevant form.

Quality of Services report

The universal postal service provider and the provider of postal services substituting the universal postal service are required to report annually by means of this form, no later than by 31 March of the year following the reference year, on the fulfilment of the quality requirements for universal postal services as prescribed by law and in the Universal Postal Service Contract applicable to universal postal services, as well as on their related quality assurance activities.

Price cap report by 30 June

Every calendar year, no later than by 30 June of the year following the reference year, the universal postal service provider shall submit to the Authority a report using an electronic form, regarding any changes in the tariffs for postal services.

Data reporting on individual contracts

Every calendar year, no later than by 31 January of the year following the reference year, the universal postal service provider shall submit to the Authority a report using this form, regarding the details of individual contracts concluded by it deviating from the provisions of its general terms and conditions, in particular regarding any discounts contained therein.

Accounting separation documentation by 30 June

The universal postal service provider and the provider of postal services substituting the universal postal service are required to send their accounting separation documentation to the Authority using an electronic form, within six months of the last day of the financial year.

EU Commission data reporting

All postal service providers with 50 or more employees (including subcontractors), as well as all postal service providers established in more than one Member State (regardless of their number of employees) must submit to the Authority data pursuant to Article 4 of Regulation (EU) No. 2018/644 of the European Parliament and of the Council of 18 April 2018 on cross-border parcel delivery services in respect of the previous calendar year, no later than by 30 June of each calendar year.

Pursuant to Article 5 of Regulation (EU) 2018/644 of the European Parliament and of the Council of 18 April 2018 on cross-border parcel delivery services, all postal service providers with 50 or more employees (including subcontractors), as well as all postal service providers established in more than one Member State (regardless of their number of employees), must submit to the Authority the public list of tariffs applicable on 1 January of the year concerned for postal services, no later than by 31 January of the calendar year in question.

Postal market data reporting by 31 March

Postal service providers are required to submit postal market data annually, in accordance with NMHH Decree 6/2017 (VI. 21.). The data must be sent electronically to the NMHH by 31 March of the year following the reference year via the Data Gateway interface, using Citizen Portal/DÁP identification.

The data reporting must include the net revenue from services, quantitative data, costs and indicators relating to the conditions of service provision, broken down by service.

In the case of an operator with multiple service authorisations, the relevant forms must be completed for the services for which prior notification has been made. If a service provider fails to fulfil its obligations adequately or on time, the Authority may initiate a supervisory procedure, and may impose a fine of up to a specified percentage of the previous year’s net revenue.

Branding mark (logo) notification form

For registration purposes, any economic entity wishing to provide a postal service which is not a substitute for the universal postal service, i.e. a competitive market-based postal service, is required to notify the Authority of its intention to commence this activity 45 days before starting the service.

The notification must be accompanied by, among other things, a sample of the mark to be used by the notifying entity for identifying the postal service provider, via a Data Gateway form. Prior to registration, the Authority will verify whether the information contained in the notification and the annexes thereto meet all legal requirements.

Revenue data reporting by 31 May

According to NMHH Decree 7/2016 (X. 14.), postal service providers are required to report to the Authority on the amount of their final annual domestic net turnover earned from electronic communications or postal services in the previous year, without being expressly requested to do so by the Authority, by 31 May each year. The supervisory fee is calculated on the basis of this amount.

Reports must be submitted for each year when a service provider was registered with the Authority as an electronic communications or postal service provider, even if the operator concerned did not generate any revenue from such services in a given year.

Postal service providers are required to use the electronic form.
