Notification of media services and press products

Media service activities and the publication of press products in Hungary may be carried out subject to notification and registration with the Office of the National Media and Infocommunications Authority (hereinafter referred to as the Office), in accordance with Act CLXXXV of 2010 on Media Services and Mass Media (Media Act), with the exception of analogue terrestrial (FM) radio media service provision rights, which may be awarded through tender procedures announced by the Media Council. The Office shall maintain an official public register of registered media services and press products.

Notification of linear media services

The future provider of a linear radio or audiovisual media service may initiate its registration with the Office. The notification must be made at least 45 days before the commencement of the activity, and must include the data required by law. The Office shall decide on registration by means of an official decision.

Notification of an on-demand media service

The media service provider of an on-demand media service may initiate its registration with the Office. Registration is not a precondition for commencing the service. However, within 60 days of commencing the activity, the media service provider must notify the Office, providing all data required by law. The Office shall register the on-demand media service by means of an official decision.

Reporting of supplementary media service

Any supplementary media service provided by a media service provider established in Hungary and falling under the scope of the Media Act must be notified to the Office for registration purposes within sixty days of the commencement of the service. The Office shall register the supplementary media service within thirty days. The data relating to the names and contact details of media service providers and the names of media services contained in the register of supplementary media services kept by the Office are public and accessible from the Office's website.

Recognition of a linear media service as a community media service

Linear media services may, by their nature, be either commercial or community media services. The Media Council decides on recognition as a community media service in an official procedure. Media services provided using terrestrial radio frequencies can only be recognised as community media services in a tender procedure initiated for the use of the entitlement, while media service providers operating linear media services on the basis of a notification may, following registration, apply for recognition of their media services as community media services in a separate official procedure.

Notification of press products

The publisher of a press product (whether printed or online) must notify the Office within 60 days of commencing the activity. Press products – including both printed and online content – must be registered separately. The information in the register is public and available on the Authority's website.

Requesting official certificates and certified copies of press products

The register of press products is considered a public official register. This means that the NMHH Office may issue an official certificate confirming the data contained in the register, for example whether a press product notification has been submitted, who its publisher is, when it was registered, and what data are recorded in relation to it. In addition, the Act provides for the issuance of certified copies of documents contained in the register (e.g. notification documents) in accordance with the general rules of administrative procedure. These are issued by the Authority at the request of the client or other authorised person.
