Ruling confirms that refusing Klubrádió’s request for renewal is lawful

With its ruling published today, the Budapest Regional Court confirmed that the request for the renewal of the entitlement to frequency used by Klubrádió was rejected lawfully, and on statutory grounds for exclusion by the Media Council.

The Media Council acted lawfully, in accordance with the provisions of the Media Act, when it rejected the request for the renewal of the licence to provide media services on the Budapest 92.9 MHz frequency, the Budapest Regional Court stated in its ruling of 9 February rejecting the action brought by Klubrádió.

The court stated that, on statutory grounds for exclusion, the Media Council had no choice but to refuse the radio’s request for the renewal.

The ruling stated that since Klubrádió had not appealed concerning its repeated infringements, which constituted grounds for exclusion, they had become final, so there was no choice but to refuse the request for the renewal.

Klubrádió’s seven-year administrative contract on the use of the Budapest 92.9 MHz frequency lasts from 14 February 2014 to 14 February 2021. The Media Council rejected the radio’s request for the renewal in September 2020 in accordance with the provisions of the Media Act.
