Subject: Renewal of entitlements of radio spectrum use in the 2100 MHz frequency band
Decision
The National Media and Infocommunications Authority (hereinafter referred to as “Authority”), at the request of NAME OF THE SERVICE PROVIDER (#ADDRESS OF THE SERVICE PROVIDER, Cg.: #COMPANY REGISTRATION NUMBER, hereinafter referred to as “Eligible Service Provider”),
hereby renews
the Eligible Service Provider’s entitlements of radio spectrum use in the 2100 MHz frequency band, for the 1940 – 1960/2130 – 2150 MHz frequency range (hereinafter referred to as “Frequency Range”) for a period of 15 years, with the possibility of a 5-year extension.
The Authority enter into a public contract with the Eligible Service Provider in order to settle the conditions for obtaining the entitlements of radio spectrum use and the rights and obligations associated with the entitlements of radio spectrum use.
Reasons
In response to the information sent by the Authority pursuant to Section 34/G of NMHH Decree 7/2012 (I. 26.) on certain administrative procedures of civil spectrum management (hereinafter: “CSM Decree”), the Eligible Service Provider clearly requested the renewal of its entitlements of radio spectrum use for the Frequency Range in its statement registered under number K/...-1/2025. The renewal procedure has been launched on the basis of the request.
Pursuant to Section 23 of Act C of 2003 on Electronic Communications (hereinafter referred to as “Electronic Communications Act”), the Authority shall apply the provisions of Act CL of 2016 on General Public Administration Procedures (hereinafter referred to as “GPAP Act”) subject to the exceptions and supplements contained in the Electronic Communications Act, with the exception of non-civil spectrum management administrative procedures.
In view of the foregoing, the Authority issued a decision on the renewal pursuant to Section 34/F (2) of the CSM Decree, with the proviso that, in addition to determining renewability, it shall conclude a public contract with the Eligible Service Provider in order to determine other provisions and conditions related to the acquisition and terms of entitlements of the radio spectrum use and the rights and obligations associated with the entitlements of radio spectrum use.
The Authority adopted a simplified decision in the procedure pursuant to Section 81(2)(a) of the GPAP Act.
The Authority's competence under Section 10(2) of the Electronic Communications Act is based on Section 10(1)(10).
