Authority proceedings initiated upon request for violation of regulations governing electronic communications

Pursuant to Section 138 of Act C of 2003 on Electronic Communications (Electronic Communications Act, Eht.), the investigation of complaints and reports is primarily the responsibility of the service provider. The service provider has 30 days to investigate reports and complaints submitted in writing. The service provider is required to send the results of the investigation to the customer in writing and to provide a justification for the rejection of the complaint

If the service provider has likely violated the rules governing electronic communications or failed to comply with the general terms and conditions, a complaint may be filed with the NMHH in accordance with Section 32 of the Electronic Communications Act, provided that the complaint meets the specified formal and substantive requirements. Based on the request, the authority will investigate your complaint in a supervisory proceeding.

Upon submission of the application, the fee for the procedure is 6,000 HUF, which must be paid by bank transfer prior to submitting the application to the Authority’s bank account No. 10032000-00300939-00000017 held with the Hungarian State Treasury.

To pay the procedural fee, you must first request a payment reference number using the "Form for Requesting a Payment ID." When paying the fee, you must include the requested payment reference number in the "Remarks" field in the format NMHH-XXXXX-XXXXX-XXXXX-XXXXX. Please also include the payment ID in your application. Requirements regarding the form and content of the application

  • The request must be submitted in writing to the authority, including identification information (name, address) and documents demonstrating the direct legitimate interest and the likelihood that such interest will be harmed. If you wish to act through an authorized representative, a signed power of attorney must be attached to the submission.
  • Upon receipt of a properly submitted application, the authority will initiate first-instance proceedings in accordance with the rules of administrative procedure. During these proceedings, the applicant is considered a party to the case and is therefore entitled to the rights and subject to the obligations of a party.
