The members of the Online Platform Dispute Resolution Board have been appointed

On 18 July, the members of the Online Platform Dispute Resolution Board were appointed by András Koltay, President of the NMHH. The soon-to-be-established professional conciliation body will help to ensure a more efficient and fair out-of-court settlement of disputes between online platforms and their users.

The EU's Digital Services Act (DSA) allows online platforms to settle user disputes out of court through certified dispute resolution bodies. These bodies may not make binding decisions unless the online platform itself recognises them as binding, but they do create the possibility for persons with the appropriate expertise to decide in a time- and cost-effective way on disputes that users of the online platform cannot resolve directly with the service provider. Dispute resolution organisations under the DSA are certified by the Digital Services Coordinator in the place of establishment, confirming their independence and their ability to provide fast and efficient dispute resolution for the parties.

Under the DSA, Member States can also set up such bodies: in Hungary, the Act on Certain Rules for Internet Intermediary Services provides for the Online Platform Dispute Resolution Board, which is responsible for out-of-court settlement of disputes under the DSA in accordance with the EU Regulation.

The Online Platform Dispute Resolution Board is composed of members with relevant experience and legal qualifications, some of whom may be proposed by national organisations that have been involved in professional advocacy and self-regulation for at least three years in the field of the protection of minors, the information society, media content providers and electronic communications service providers. Among others, the Association of Telecommunications and Information Science, the Self-Regulatory Advertising Board, the Association of Hungarian Newspaper Publishers, the Association of Hungarian Electronic Media Service Providers and the Association for Information Technology and Society have recommended members.

The President of the Media Authority has selected seven experts from various professional organisations and has delegated two additional members to the Board in accordance with the relevant NMHH Decree, with a view to ensuring that the selected members bring expertise from different fields to contribute to the effective functioning of the new body. Once the Board is established, it adopts its rules of procedure and applies to the President of the NMHH for certification. The Board may start its activities after this certificate has been issued and the Board has been registered.
