Invitation to the consultation held about the draft documentation of the auction procedure announced for the entitlements of frequency use of the 900 MHz and 1800 MHz frequency bands

Based on Article 40/A (4) of Act C of 2003 on Electronic Communications (hereinafter: Electronic Communications Act), the Office of the National Media and Infocommunications Authority (hereinafter: Auctioneer) is holding a consultation about the draft tender documentation (hereinafter: Documentation) of the auction procedure for the entitlements of frequency use of the 900 MHz and 1800 MHz frequency bands (hereinafter: Auction) at 10 AM, 29 September 2020 in the Dome Room of MOM Cultural Centre (1124 Budapest, Csörsz u. 18.); online participation is also possible.

At the consultation, representatives of the Auctioneer will be providing detailed information primarily regarding the parameters and use of the available spectrum, the conditions of usage, the activities that can be carried out using the frequencies at hand as well as the rules of procedure, process, form and basic rules of the Auction.

Having regard to the current epidemic situation, the Auctioneer recommends participating in the consultation primarily through connection to the online interface; the personal presence of only a limited number of people can be ensured. Personal appearance is primarily recommended to representatives of organisations that would like to make use of the possibility of onsite questions/comments.

The consultation is not open to the Press. Participation at the consultation requires registration in advance. Interested parties should indicate their intention to participate in the consultation and submit the name of the represented organisation, the name and email address of the participant(s) and the form of participation (online or personal) not later than 12 PM on the day before the day of the consultation, 28 September 2020 on the following email address: mobil2020@nmhh.hu. Involved parties will be notified directly about the technical conditions of the online participation based on their pre-registration.

Each natural person, legal entity and other legally competent organisation may be represented by up to 4 people, but only 1 of them may be present personally at the venue of the consultation. In case of onsite participation, a proof of proxy authorisation shall be provided before the start of the consultation.

Pursuant to Article 40/A(6) of the Electronic Communications Act, the Auctioneer shall respond to the questions presented verbally at or submitted in writing not later than the day of the consultation in writing within ten days upon the date of the consultation, and, with the exception of any sensitive information protected under Article 33 of the Electronic Communications Act, shall disclose the responses on its website. The responses thus made public by the Auctioneer are informative and, contrary to the Documentation, have no legal effect or legal binding force with regard to individual administrative proceedings or administrative decisions.
