The economic regulation of the electronic communication sector is, in many ways, related to the market analysis procedures. In accordance with the Act C of 2003 on Electronic Communications (Eht.) the NMIA has the authority to identify the relevant markets, examine the competition and its efficiency on the relevant markets, identify the service providers with significant market power (SMP) on the relevant markets and to determine the obligations (Eht. 10. § f) for service providers with SMP in order to remedy problems on the market.
In accordance with the corresponding recommendation of the European Commission (2003/311/EC) the Council of National Communications Authority delivered its decisions and carried out the market analysis procedures mostly in 2005. In case of most of these markets the Council has already delivered its second decision, since the Eht. prescribes a market analysis procedure for every two years at most.
